Sureshwar Singh, the BJP MLA for Uttar Pradesh, may lose his eligibility to serve in the assembly after an MP-MLA court in Bahraich sentenced him to two years in prison and fined him Rs 2,500 in a case involving criminal intimidation and preventing a public servant from performing his duties. The case dates back to 21 years.
Five witnesses for the prosecution were questioned by Senior Division Additional Civil Judge Anupam Dixit throughout the trial. On Thursday, the court fined MLA Sureshwar Singh Rs 2,500 and gave him a two-year jail sentence. Nonetheless, the ruling was made public today, Friday, according to government attorney Tabassum for Bahraich.
The government attorney added that Singh, a two-time MLA from the Mahasi constituency in the Bahraich district, has been found guilty under the provisions of the Criminal Law Amendment Act as well as sections 506 and 353 of the Indian Penal Code (IPC), which deal with criminal intimidation and assault or use of force to prevent a public servant from performing their official duties, respectively.

His imprisonment could result in his disqualification from the Uttar Pradesh Assembly. As per the Representation of the People Act (RPA) 1951, public representatives who receive sentences of two years or more in jail are automatically disqualified from office on that date and are prohibited from running for office for the following six years following their release.
The prosecution claims that on September 2, 2002, a lady who was staying at a protection home in Lucknow was taken to the Sub-Divisional Magistrate’s (SDM) office to record her statement in a case. Until the recording, no one was permitted to enter the SDM’s chamber.
But, Sureshwar Singh, the accused, forced his way into the SDM’s chamber. When asked to leave, he misbehaved with the authorities. After an altercation, he was also accused of threatening others while he was exiting the SDM’s room, according to a prosecution officer.
According to the prosecution, Singh entered the Mahasi MLA’s office and caused disruption in government work. He said that Mahasi tehsil SDM Lal Mani Mishra had filed a complaint against the Mahasi MLA at the Hardi police station. According to the prosecution, the complainant claimed that the MLA had mistreated him and threatened him.
Authorities claim that when Singh got into a fight with the then-SDM over a disagreement in September 2002, he filed a formal complaint. Singh had gone to the SDM’s office for a public matter.
The order stipulates that the MLA would spend an additional seven days in jail if he does not pay the fine. A Bahraich sessions court cleared the MLA and three other defendants in a 1995 triple murder case due to a lack of evidence in September 2019. But four other people, including his older brother Brijeshwar Singh, received life sentences. Each of them was also fined Rs 50,000 by the court.
Thus far, four MLAs who were victorious in the last Assembly elections have been ousted from the Uttar Pradesh Assembly.
